What is a Paternity Leave in PH?

A Paternity Leave in the Philippines (PH) allows all male employees to take seven (7) days paternity leave to bond with and care for their newborn child and family. This is in accordance with Philippine Labor Law.


Duration

Male employees are entitled to a 7-day paternity leave for each of the first four deliveries (including childbirth, miscarriage, or emergency termination of pregnancy) of their legitimate spouse and the leave should be taken within 60 calendar days from the date of their child's birth.


I am not yet a regular employee, am I eligible for this?

Regardless of employment status (regular, probationary), you are eligible for this. 


How do I avail the Paternity Leave?

  • Notify Your Employer: Inform your employer as soon as you learn of your spouse’s pregnancy. This helps your employer plan for your absence. You may be required to submit a written notice stating the expected date of delivery or miscarriage. It's a good idea to provide this notification as early as possible.
  • Provide Necessary Documents: Submit required documents to your employer, which may include:
    • Marriage Certificate as proof of your legal marriage.
    • Medical Certificate or Birth Certificate as proof of the pregnancy, delivery, or miscarriage once it occurs.
  • Complete Leave Application Forms: Fill out any necessary leave application forms provided by your company. Each company may have its own specific procedures or forms, so check with your HR department.
  • Avail of the Leave: Once approved, you can take 7 days of paid paternity leave, which must be taken within 60 days of the child’s birth or miscarriage.
