What is a Maternity Leave in PH?
A Maternity Leave in the Philippines (PH) allows female employees to take leave to prepare and recover from childbirth (or miscarriage/emergency termination of pregnancy). This is in accordance with Philippine Labor Law where it states that all pregnant employees are entitled to maternity leave and benefits under the Social Security System (SSS).
Duration
- A female employee is entitled to 105 Days Paid Leave whether they give birth via normal delivery or caesarean section. An additional 15 Days Paid Leave for Solo Parents.
- However, female employees have the option to extend their maternity leave by 30 days, but this extension will be unpaid.
- If the pregnancy ends in a miscarriage or the employee suffers an emergency termination of pregnancy (including stillbirth), she is entitled to 60 Days of Paid Leave.
I am not yet a regular employee, am I eligible for this?
Both probationary and regular employees who have contributed to the SSS for at least three months in the 12-month period before childbirth, miscarriage, or pregnancy termination are eligible for this leave. A female employee can start her leave up to 45 days before childbirth or use the full 105 days (120 for solo parents) after delivery.
What are the requirements for a Maternity Leave?
- Duly filled out SSS Maternity Notification Form (Scanned copy with the 4 sides of the paper must be visible and clear)
- SSS Maternity Allocation Leave Form (Scanned copy and the 4 sides of the paper must be visible and clear)
- Photocopy of Employee's 2 Valid IDs, with 3 specimen/wet signatures
- Ultrasound Report and Film with EDD (Certificate of True Copy stamp)
- SSS Annual Premium Contributions (SSS Online Account)
How Do I file for Maternity Leave?
- Notify your employer: Inform your employer about your pregnancy and expected delivery date at least 30 days before you plan to take maternity leave. Submit a written notice and provide medical documents such as a doctor’s certificate.
- Submit SSS documents: Provide your employer with your SSS Maternity Notification form, which you can download from the Social Security System (SSS) website, along with proof of pregnancy (ultrasound or medical certificate).
- Employer submission: Your employer will submit the documents to the SSS on your behalf to process your maternity benefit claim.
- Receive SSS benefits: Once approved, the SSS will pay your maternity benefit to your employer, who will then release it to you, typically in a lump sum.
- Post-birth submission: After childbirth, submit a birth certificate to your employer, who will forward it to SSS to complete the documentation.
